Terms of Use

We, at Brainpulse Technologies Private Limited, provide an online platform to subscribe or register, for use and availment of the services of the website www.lovelites.co.in (Website, Us, We, Our, Lovelites) and the associated mobile application (collectively, the App) for accessing, downloading or using. The App may be used for connecting and talking with other users based on the users’ requirements through the App, Lovelites chatline and sub-pages, mobile application linked, or otherwise connected thereto (collectively, the Services).

By accessing, downloading, or using our Services, you agree to be bound by these Terms of Use (Terms). These Terms state the grounds on which a user can use the Services and must be read in conjunction with the Privacy Policy, both shall form a legally binding agreement. Lovelites may offer additional services, alter, suspend, discontinue, or revise any of the Services, including availability of any Service feature at its discretion at any future date in which case these Terms of Use shall apply to all additional services or revised Services. You should check these Terms of Use periodically for changes. All rights to cease offering any of the Services on the Website are reserved with Lovelites. If you do not agree to be bound by these terms and conditions, do not use or register with the Website or make use of the Services. Your use, registration or participation in any manner with the Site or the Services being provided confirm, agreement to the Terms of Use.

SERVICES

1. Users must be at least of the legal age (minimum 18 years of age) to register with us and avail our Services. By using the Services on the Website, the User represents and warrants that he/ she is a minimum 18 years old.

2. Lovelites provides Users with online voice call communications and general user interaction related services, including but not limited to all software and services made available through the Lovelite website, and the App.

3. Lovelites takes utmost care to screen all applicants and ensure their eligibility and suitability to join Lovelites but does not make any representations about or stand guarantee to the character of its Users.

4. The Service(s) provided to You can be restricted and limited to be between a certain time frame on a daily basis. The time frame for which Services are available are currently fixed between 9 AM to 11 PM IST (Service Hours). Any request of service before or after Service Hour(s) will not be entertained. The Service Hour(s) are subjected to change at our sole discretion, and you will be notified of the changes when they avail the service(s).

5. You can dial the designated number 9289244862 and proceed to register and access the Services by paying the fee stipulated in the chosen subscription plan (Subscription Fee). The Users will be sent a link via short messaging service to get priority access link for purchasing a subscription plan. Your membership will be activated only after Lovelites receives your payment of the Subscription Fee from the third-party payment processor. Your subscription will end when the period of subscription is over unless you renew your subscription by paying a fresh Subscription Fee. Any tax/levies/duty etc., as applicable, shall be paid by the User for the Services provided by Lovelites. The Subscription Fee paid is non-refundable, except as otherwise provided expressly in these Terms. Lovelites reserves the right to modify its subscription plans and Subscription Fees at any time.

6. Any charges incurred by the Users related to the accessing the Services including but not limited to the normal rates and fees of your telecommunications or network provider, such as SMS and mobile data charges as may be applicable shall remain the full responsibility of the Users.

7. The audio content of the voice introductions that you post on Lovelites will continue to be retained and stored under normal circumstances. Users will have a limited access to the Service, and we retain the right to the deletion of your audio file without prior notice at our own discretion.

8. Further, we collect, and store the voice recordings of your interactions, conversations with other users on our Platform, for the strict and limited purpose of grievance redressal, sharing it ahead with regulatory bodies, law enforcement authorities (LEA), as and when requested by them. We and the Users will have limited access to this data, save where there is a requirement to share this ahead with LEAs, or in order to address a grievance shared by you in relation to such specific conversation recordings.

9. The content made available through the Services is provided on an “AS IS” basis. We do not make any representations, warranties, or guarantees, in relation to the quality, suitability, truth, accuracy or completeness of any content made available on the Platform. The Users acknowledge the sole responsibility for and assume all risk arising from your use or reliance of any content.

Use of Services.

10. Once an account is created it is for the User’s personal use only. The User may not authorize others to use the account. The account is non assignable and non-transferable to any third party whether a person or an entity. The User acknowledges and confirms that Lovelites is not responsible for third party access to the User’s account that results from theft, hacking or misappropriation of user names and passwords. Furthermore, Lovelites shall not be responsible for any loss that Users may suffer as a result of an unauthorized access to their accounts and/or use of the Services and Lovelites accepts no responsibility for any losses or harm resulting from this unauthorized use, whether fraudulently or otherwise.

11. A User shall not register or operate more than one User account with Lovelites.

12. You are advised against sharing any personal information about yourself, on the audio introductions on the Platform. Lovelites is not responsible to any user who intentionally, or otherwise, disclose their personal information in the audio introductions or in any publicly accessible forum on the Platform, or otherwise.

13. By applying to be a User, you consent to receive communication from Lovelites across such modes of communication that you have opted for. This consent shall supersede any registration, or preferences set, by you with the Do Not Disturb Register.

14. You are granted a limited, personal, royalty-free, non-assignable, non-exclusive and revocable license to use the software that is provided as part of the Services. This license is for the sole purpose of enabling the own personal private use from Users to avail the Services as provided by Lovelites in the manner according to these Terms. We may make changes to the service, application, or website for maintenance at any time. If such situations cause an interruption of paid-for Services for a reasonable duration, Lovelites shall not bear any liability to you and/or to any third parties. Lovelites will make attempts on a best-efforts basis to let you beware of any scheduled maintenance to such extent as is possible.

15. The Services may change or be modified from time to time without prior notice or communication. Furthermore, Lovelites may, at its own discretion, cease totally or partially, and/or permanently or temporarily the provision of the Services or Users accounts without prior notice or communication.

16. The Services may include advertisements, which may be targeted or information on the Services, queries made or any other information. The User(s) consent to receiving communications such as announcements, administrative messages, and advertisements from Lovelites and/or any of its affiliates, subsidiaries, associates, licensors, and partners. The types and extent of advertising by Lovelites on the Services are subject to change.

17. Users are solely responsible for the content that you record, communicate or transmit to other Users. The content available through the Services has not been verified for its authenticity.

18. To the extent that these Terms are inconsistent with any applicable laws, Lovelites may, at its sole and absolute discretion:

a. Restrict, suspend, or terminate any User's access to all or any part of Lovelites or its Services;

b. Change, suspend, or discontinue all or any part of the Services;

c. Reject, move, delete or remove any material that may be submitted by a User;

d. Move or remove any content that is available to the Users;

e. Deactivate or delete a User's account and all related information and files on the account;

f. Establish general practices and limits concerning use of the Services;

g. Assign its rights and liabilities to all User accounts hereunder to any entity, which shall be communicated to the users.

19. In the event any User breaches, or Lovelites reasonably believes that such User has breached these Terms of Use, or has illegally or improperly used Lovelites or the Lovelites, Lovelites at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User's access to all or any part of the Services, deactivate or delete the User's account and all related information on the account, delete any content posted by the User while using the Services and further, take technical and legal steps as it deems necessary.

Offline interactions between Users.

20. We urge you to interact with other users on the Platform, and if you decide to meet them in-person, or during an offline visit, in a physical location, we advise you to first become familiar with the person, prior to agreeing to meet them in-person.

21. Lovelites does not bear any responsibility for any actions of the users during their in-person meetings.

22. When interacting with other Members, you agree that:

a. You will be using your discretion when sharing personal information through Lovelites.

b. You will only disclose information that you are comfortable disclosing to another, during the call, or in the voice introduction.

c. You will be using your discretion when meeting and interacting with other Users and Lovelites shall not be held responsible for any acts or actions carried out at the Users own discretion.

d. You will use in a lawful and responsible manner, any information (personal or otherwise) provided by other Users.

e. You will not use Lovelites, or any information provided there to solicit business or use it for commercial purposes.

f. You will not communicate, record or transmit content that is obscene, hurtful, defamatory, violative of copyrights or trademark rights, or violative of any law applicable to publication of such content.

INTELLECTUAL PROPERTY

23. Users acknowledge that all copyright, trademarks, and other intellectual property rights in and related to the Services is owned by or licensed to Lovelites. Users must not copy, distribute, make available to the public or create any derivative work from any content belonging to Lovelites and/or any other User. Lovelites respects the intellectual property rights of others and expects Users to do the same.

24. Users agree to not copy, modify, transmit, create any derivative works from, make use of, or reproduce in any way any copyrighted material, trademarks, trade names, service marks, or other intellectual property or proprietary information accessible through the Service, without first obtaining the prior written consent of Lovelites. By uploading, transmitting, importing or otherwise providing for the purpose of the Service, any information, files, etc., you represent that you authorize the Lovelites to use, modify or re-use unconditionally for commercial or non-commercial purposes.

25. User’s voice introductions, voices, texts, scripts, graphics, music and other audio combinations, interactive functions and other materials submitted during obtaining the Service shall ensure that they do not violate third-party rights (including but not limited to intellectual property rights) unless you have obtained permission from the legal owner of the content, or you have the right to post the content and grant Lovelites the appropriate license.

26. If Users or any third party believe that their content has been copied in a way that constitutes copyright infringement, they shall provide Lovelites with the following information: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the location of the material; (iv) contact information, including address, telephone number, and an email address; (v) a statement that such User or third party have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that such User or third party is authorized to act on behalf of the copyright owner.

27. All right, title, and interest in and to the Services, according to the provisions set on these Terms of Use are and will remain the exclusive property of Lovelites and its licensors. Services are protected by copyright, trademark, and other laws. Nothing in the Terms gives Users any right to use the Lovelites name or any of the Lovelites trademarks, logos, domain names, properties, and other distinctive brand features, without the prior written consent of Lovelites.

28. Lovelites reserves the right to remove content alleged to be infringing without prior notice, at its sole discretion, and without any liability.

Breach

29. Lovelites reserves the right at all times to remove or refuse to include, distribute and/or display any content on providing the Services, to suspend or terminate Users, and to reclaim usernames and/or any channel name without any liability.

30. Lovelites also reserves the right to access, listen, record, preserve, and disclose any information as it reasonably believed is necessary to satisfy any applicable law, regulation, legal process, or governmental request, enforce the Terms, including investigation of potential violations hereof, detect, prevent, or otherwise address fraud, security, or technical issues, or to protect its rights, property or safety, its Users and third parties.

31. In the event of any breach, Users who caused such breach shall compensate Lovelites for all losses, harm, claims and expenses that may arise.

32. These Terms will continue to apply until terminated by either Users or Lovelites as follows: (i) Users may end this legal agreement with Lovelites at any time for any reason, by discontinuing the use of the Services and contacting support@lovelites.co.in to delete their account, provided that they will still be responsible for all the conditions set in these Terms.

33. Accounts may be deactivated and/or deleted due to prolonged inactivity; (ii) Lovelites may suspend or terminate Users accounts or cease providing with all or part of the Services at any time for any reason, including, but not limited to, if there is a reasonable belief that such Users have violated these Terms of Use or created a risk or possible legal exposure; or if at its own discretion the provision of the Services is no longer commercially and or technically viable. Termination shall not affect any liabilities incurred by the User prior to the termination or for acts performed while registered with Lovelites which may result in a dispute post termination, nor any provision expressed to survive or to be effective on termination shall expire. The obligations set out in this Section shall remain in full force and effect notwithstanding termination.

Limitation of Liability

34. User will keep all information provided to you through the Services as private and confidential and will not give such information to anyone or use such information without the express permission of the person who provided it to you.

35. User will not use the Services to engage in any form of harassment, illegal, immoral or offensive behavior, including but not limited to the posting of communications, pictures, or audio or video recordings which contain, depict or suggest libelous, slanderous, abusive or defamatory statements, or racist, pornographic, obscene, or offensive language or images, or promotes bigotry, hatred or physical harm of any kind against any group or individual.

36. User will not record, reproduce, post or distribute any audio or video communications between you and another User or Member of the Services, including any messages, pictures or recordings you obtained from the Services or your use of the Services.

37. User will not use the Services in any way which (i) violates, plagiarizes or infringes upon the rights of any person, including but not limited to any copyright or trademark law, privacy or other personal or proprietary rights, including other intellectual property rights; (ii) is fraudulent, misleading or otherwise unlawful or violates any law, rules, or regulations in Canada, the United States or any relevant jurisdiction in which you use the Services; or (iii) promotes or results in communications concerning illegal activities or conduct such as making or buying illegal weapons, selling drugs, soliciting prostitution or violating someone's privacy.

38. User will not use the Services to distribute, promote or otherwise publish any material containing any solicitation for funds, or advertising or solicitation for goods or services.

User Conduct

39. Users agree to abide by these Terms and all other rules, regulations of the Services.

40. In the event User does not abide by these Terms and all other rules, regulations and terms of use, Lovelites may, at its sole and absolute discretion, take necessary remedial action, including but not limited to:

a. restricting, suspending, or terminating any User's access to all or any part of the Lovelites Services;

b. deactivating or deleting a User's account and all related information and files on the account.

41. The Users further agree to the below:

a. Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by Lovelites). Users further agree to update and keep updated their registration information.

b. As applicable Users agree to exit/log-out of their accounts at the end of each session. Lovelites shall not be responsible for any loss or damage that may result if the User fails to comply with these requirements.

c. Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying Lovelites or Lovelites Services.

d. Users agree that without Lovelites’ express written consent, they shall not modify or cause to be modified any files or software that are part of Lovelites Services.

e. Users agree not to disrupt, overburden or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support Lovelites Services (each a "Server"); or (b) the enjoyment of Lovelites Services by any other User or person.

f. Users agree not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service, or other attempts to disrupt Lovelites Services or any other person's use or enjoyment of Lovelites Services.

g. Users shall not attempt to gain unauthorized access to the User accounts, Servers or networks connected to Lovelites Services by any means other than the User interface provided by Lovelite, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of Lovelite Services.

h. Users shall not cause to transmit any audio content which is in violation of the applicable laws.

Grievance Redressal Mechanism

42. In case you have any complaints or grievance pertaining to: (i) Any user content that you believe violates these Terms for the reporting mechanism for such claims),, (ii) your access to the Services provided by Lovelites or (iii) any content which you believe is, prima facie, in the nature of any material which is obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force or defamatory towards the complainant or any person on whose behalf you are making the complaint, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual, please share the same with us by following the procedure made available with your User account on the Platform. The Users may share such grievances, and will receive an e-mail ticket, to maintain track of the progress of their grievance redressal procedure.

43. On receiving such complaint, grievance or notice, Lovelites reserves the right to investigate and/or take such action as Lovelites may deem appropriate. Lovelites may reach out to you to seek further clarification or assistance with the investigation, or verify the statements made in your complaint, grievance or notice, and you acknowledge that your timely assistance with the investigation would facilitate the redressal of the same.

45. The Grievance Officer identified above is pursuant to the provisions of applicable laws including but not limited to the Information Technology Act, 2000 and the Consumer Protection Act, 2019, and the Rules enacted under those laws.

46. Lovelites reserves the right to replace the Grievance Redressal Officer at its discretion through publication of the name and title of such replacement on the website, which replacement shall come into effect immediately upon publication.

Dispute Resolution

47. These terms shall be governed by and construed in accordance with the laws of Republic of India. All claims, legal proceedings or litigation arising in connection with the Services will be brought solely in the relevant courts of New Delhi, India. Users consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.
